Our Cancellation and Refunding Policy

1. This document states and clarifies the terms of cancellation and refunding referring to the sales and purchasing processes realized via the Domain name of www.cloudspex.com which is founded, owned and managed by Nishgroup Bilgi Teknolojileri San. Tic. A.Ş. (will be mentioned hereby as CLOUDSPEX).

2. Referring to the sales and delivery of the product(s)/service(s) they purchase from CLOUDSPEX; the Buyers (will be mentioned hereby as CUSTOMERS) are subject and liable to the terms/rules of 6502 officially numbered Law On The Protection Of The Consumer and Distance Contract Regulations (6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği / RG:27.11.2014/29188), and to the current relevant other legislations.

3. Depending on and varying due to their kinds, specifications, contents and ingredients; the products and/or services which are purchased by the CUSTOMERS from our website of www.cloudspex.com may or may not be cancelled/refunded within the duration(s) indicated in this policy. Cancellation and refunding terms and conditions are indicated in the following clauses.

4. The contract date for this refunding policy is the purchasing/buying date of a product(s)/service(s) which is/are put into process by CLOUDSPEX by the request and demand of the CUSTOMER(S) from CLOUDSPEX with reference to a valid product or service contract(s) agreed between the both parties.

5. Cancellation and refunding are only valid for the new purchases which the CUSTOMER(S) make. No cancellation(s) or no refund(s) will be made/realized to the CUSTOMER(S) for the renewal(s) and/or upgrading(s) of its (their) previously bought package(s).

6. The cancellation time durations/periods of the products/services with reference to their dates of purchases are as follows:

For Yearly/Annual Purchases (for 1-Year or longer contracts):

Within 15 days following the date of contract

Monthly Purchases (for all contracts shorter than 1 year):

For the servers, within 72 hours (3 days) following the date of contract

For all other refundable products/services, within 48 hours (2 days) following the date of contract

7. The contracts concerning the services immediately executed/performed electronically or the intangible products/goods that are delivered immediately/right away to the consumers/CUSTOMERS through the electronic environment/media cannot be cancelled, and/or the CUSTOMER cannot demand/request any refund(s) for these kinds of contracts. The products and services within this context are:

Domain names (registrations and renewals)

All third-party licences

SSL and security products

Server products and services (subject to special refunding conditions and terms)

8. Within the scope and limits or refunding terms; no kinds of costs/returns of the products/services that are presented/given/performed immediately as a complimentary gift to/for the CUSTOMERS within the scope of a marketing campaign are refunded. In these cases, the refund is realized by substracting the price(s) of the complimentary gift(s)/product(s)/service(s) from the total refund amount/value.

9. In case the Domain transfer cannot be completed due to various reasons; o “passcode” which provides/supplies the CUSTOMER the right to buy/purchase a Domain name is issued and forwarded to the referring CUSTOMER.

10. The CUSTOMERS may receive their refunds either by back payments sent/made to their payment methods/tools, or have them credited it on their virtual cards.
